COVID-19 brought a lot of devastation that went far beyond the physical. We don't use the word lightly, but luckily there were some regulations put into place throughout the length of the pandemic at both the federal and state level that helped those who suddenly found themselves jobless. Eviction moratoriums prevented landlords from kicking out non-paying renters and stopped lenders from moving forward with foreclosures when homeowners missed mortgage payments.
The moratoriums have now come to an end, and NJ Sheriff Sales are back on the calendar. You should be paying attention if you are a homeowner in New Jersey who is behind on your mortgage payments. Many people have been caught resting on their laurels, too comfortable with not making rent or mortgage payments for over a year.
Now, when we say that NJ Sheriff Sales are back, the good news is that foreclosure defense is one of the things we do best at Veitengruber Law. While the physical eviction (actual removal of you from your residence) cannot legally occur until January of 2022, lenders all over the state have now scheduled Sheriff Sales on the calendar. If the eviction moratorium resulted in a postponement of a Sheriff Sale that was already scheduled before the pandemic, your lender is not required to notify you of the new date.
Mortgage lenders have no restrictions right now on taking a foreclosure case all the way to Final Judgement in New Jersey.
